For the purpose of these Terms, Ordnary refers to the business operating under the name Ordnary and registered with the Dutch Chamber of Commerce under KVK number 95732888. Depending on context, Ordnary services may include products, systems, brands, and divisions such as Glint, Twomegle, Ordo, Sequence, Sequence Flash, Sequence Flash 2, Ordnary Accountcentrum, Horizon SDK, Ordnary Cloud Console, Solara, Mockscene, and Ordnary Pictures.
1. Scope of these Terms
These Terms apply whenever you visit an Ordnary website, create an account, submit a form, join a waitlist, use a dashboard, access an API, request a developer product, use a cloud or authentication service, receive media or production services, or otherwise interact with an Ordnary-operated digital experience. Additional service-specific terms, commercial agreements, proposals, statements of work, or enterprise contracts may supplement these Terms. If a separate signed agreement conflicts with these Terms, the signed agreement will control to the extent of the conflict for that specific service.
2. Eligibility and account responsibility
You may use Ordnary services only if you are legally permitted to do so and have the authority to enter into a binding arrangement on behalf of yourself or the organisation you represent. You are responsible for maintaining the confidentiality of your account credentials, API keys, access tokens, workspace settings, connected integrations, and any activity that occurs under your account or environment. If you suspect unauthorised access, you must notify Ordnary promptly and take reasonable steps to secure your environment.
You may not use Ordnary services for unlawful activity, fraud, harassment, infringement, harmful automation, unauthorised access, credential abuse, scraping that exceeds permission, malware distribution, disruption of systems, interference with other users, or attempts to bypass security, rate limits, billing controls, access restrictions, or service boundaries. You must not use Ordnary services in a way that creates unreasonable legal, operational, reputational, compliance, or security risk for Ordnary, its users, customers, partners, contractors, or the public.
4. User content, submissions, and generated output
You remain responsible for the information, files, transcripts, prompts, media, metadata, project content, contact submissions, support tickets, developer inputs, exported assets, and generated output associated with your use of Ordnary services. You represent that you have the rights and permissions necessary to provide that content and to instruct Ordnary to process it. Ordnary does not claim ownership of your underlying content, but you grant Ordnary the limited rights reasonably necessary to host, process, transmit, secure, improve, and support the relevant service.
5. Service availability and product evolution
Ordnary develops and operates a broad ecosystem of software, AI, cloud, developer, and media-related services. Some services may be public, some invite-only, some enterprise-only, some internal, some experimental, and some in alpha, beta, preview, pilot, or limited release. Ordnary may change, suspend, replace, limit, rebrand, reconfigure, or discontinue features, plans, interfaces, integrations, pricing models, access models, and service availability where reasonably necessary for product, legal, security, technical, operational, strategic, or commercial reasons.
6. AI and automation disclaimer
Certain Ordnary services may involve AI-assisted analysis, generation, transformation, classification, summarisation, or workflow automation. AI output can be useful, but it may also be incomplete, incorrect, biased, inconsistent, or unsuitable for a particular purpose. You are responsible for reviewing outputs before relying on them for legal, financial, operational, editorial, production, safety-critical, or other material decisions. Ordnary does not guarantee that AI-generated or AI-assisted output will be accurate, complete, original, or fit for a specific use case.
7. Developer, cloud, and technical services
If you use Ordnary Cloud Console, Horizon SDK, APIs, webhooks, hosting-related services, developer tools, provisioning flows, or technical integrations, you are responsible for configuring them correctly and using them in accordance with applicable documentation, security requirements, and access boundaries. You must not share credentials irresponsibly, expose sensitive endpoints, overload services, or deploy integrations in ways that would create avoidable abuse or downtime risk. Ordnary may impose technical limits, quotas, usage caps, key rotation requirements, verification requirements, or approval steps to protect infrastructure and users.
8. Media, production, and creative services
Where Ordnary or Ordnary Pictures provides production-related, creative, media, audiovisual, or content services, deliverables, schedules, timelines, revision rights, approvals, dependencies, and ownership arrangements may be further defined in a separate proposal, production agreement, statement of work, or written commercial arrangement. Project outcomes may depend on client input, approvals, assets, rights clearances, timelines, third-party vendors, and production realities outside Ordnary control.
9. Intellectual property
Unless a separate written agreement explicitly states otherwise, all rights, title, and interest in Ordnary brands, names, logos, software, source materials, interfaces, platform logic, cloud systems, SDKs, templates, design systems, AI models, internal workflows, product architecture, production tooling, editorial structures, and related materials remain with Ordnary or its licensors. Your use of Ordnary services does not transfer ownership of Ordnary intellectual property. You may not copy, reverse engineer where prohibited, resell, sublicense, frame, mirror, or commercially exploit Ordnary services beyond the rights expressly granted to you.
10. Third-party services and dependencies
Ordnary services may depend on or interact with third-party hosting providers, cloud providers, analytics systems, payment providers, email services, identity services, communication tools, operating systems, app stores, or other external systems. Ordnary is not responsible for outages, restrictions, policy changes, price changes, data loss outside Ordnary control, or compatibility issues caused by those third parties. Third-party terms may also apply to parts of your use.
11. Fees, billing, and payment
Certain Ordnary services may be offered on a paid basis, subscription basis, project basis, usage basis, pilot basis, or custom commercial basis. You agree to pay applicable fees in accordance with the relevant checkout flow, invoice, proposal, statement of work, or other written agreement. Unless otherwise agreed, fees are non-cancellable and non-refundable except where required by law or expressly stated in a separate policy or contract. Late payment may result in suspension of access, withholding of deliverables, cancellation of support, or other reasonable collection action.
12. Suspension and termination
Ordnary may suspend, restrict, investigate, or terminate access where reasonably necessary to address misuse, security issues, legal risk, billing failure, abuse, repeated violations, harmful conduct, unauthorised activity, or protection of Ordnary systems, users, partners, or the public. You may stop using the services at any time, but termination does not erase obligations that accrued before termination, including payment obligations, usage already incurred, or rights needed for recordkeeping, enforcement, and legal compliance.
13. Warranties disclaimer
To the fullest extent permitted by applicable law, Ordnary services are provided on an as-is and as-available basis. Ordnary does not guarantee uninterrupted availability, error-free performance, continuous compatibility, exact uptime, perfect security, or that every service will remain available in its current form. To the extent permitted by law, Ordnary disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, Ordnary will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, business, goodwill, opportunity, production time, data, or expected savings arising from or related to your use of Ordnary services. Where liability cannot be excluded, Ordnary liability will be limited to the amount paid by you to Ordnary for the relevant service in the twelve months before the event giving rise to the claim, unless a separate written agreement provides otherwise.
15. Indemnity
You agree to indemnify and hold harmless Ordnary, its affiliates, contractors, officers, employees, and partners from claims, losses, damages, liabilities, and costs arising out of your misuse of the services, your content, your breach of these Terms, your infringement of rights, or your unlawful or negligent conduct.
16. Governing law
These Terms are governed by Dutch law. Any dispute arising out of or relating to these Terms or your use of Ordnary services will be subject to the competent courts of the Netherlands, unless mandatory law requires otherwise.
17. Updates to these Terms
Ordnary may update these Terms where products, services, laws, infrastructure, billing models, or risk controls change. The latest published version will apply from its effective date unless a separate written agreement states otherwise.
